Templug Legal Disclaimer 

 

  1. Templug and Craig Rothleitner (Rothleitner) intend to continue to develop the Products and, as a consequence:
    1. the technical specifications and application of the Products may change from time to time; and
    2. Rothleitner may make application for patent protection in Australia and elsewhere in the world in respect of any further claimed invention which is additional to any of the inventions described in the complete specification of and made the subject of the various claims of the International PCT application PCT/AU2007/000855, such application being a combination of five (5) separate but related provisional applications, as lodged in the Australian Patent Office (International PCT application).
  2. Templug and Rothleitner make no representation or give any warranty in relation to the:
    1. commercial viability of the Products; or
    2. extent of or availability of any market into which the Products may be sold, licenced or otherwise exploited in the course of trade or otherwise anywhere in the world;
  3. Templug and Rothleitner make no representation or give any warranty as to the validity and enforceability, as a statutory monopoly, of the intellectual property:
    1. the subject of the invention(s)  as described in the complete specification and made the subject of the various claims of the International PCT  application; or
    2. as may be involved in further patent application or patent, as referred to in sub-para (a) (ii) above.
  4. Any person interested in acquiring or licencing or otherwise accessing the intellectual property in or relating to the Products, with the object of exploiting same in the course of trade or otherwise anywhere in the world, must make their own enquiries and assessments as to the:
    1. commercial viability of the Products
    2. extent or availability of any market into which the Products may be sold, licenced or otherwise exploited in the course of trade or otherwise anywhere in the world; and
    3. validity and enforceability of any application for patent or sealed (granted) patent in respect of any claimed invention in respect of the Products, including (but not limited to):

    a. the International PCT application; or

    b. as may be involved in further patent application or patent, as referred to in sub-para (a) (ii) above.

  5. Templug, and its officers, employees and agents and Rothleitner and his employees and agents are, in relation to the subject matter of this Disclaimer, not liable for any condition, warranty and term implied by any statute, general law or custom for which it or they or any of them might otherwise be liable and any applicable implied condition, warranty and term or provision in the Trade Practices Act 1974 (Cth), the Fair Trading Act 1987 (WA) or any other legislation (which cannot be excluded) is restricted or modified to the extent allowed under that legislation.
  6. Templug, and its officers, employees and agents and Rothleitner and his employees and agents will not be liable under any circumstances for any claim, suit, demand or cost howsoever caused and in respect of which but for this Disclaimer, it or they or any of them may otherwise be liable.
